1.)  I understand that this addendum to the lease is an integral part of the                            

 

 

           

      lease agreement that I have agreed to and signed with Riaz Hussain, the

             

      property owner, hereinafter referred to as Owner, or  Kinzie Oswald, the

     I also agree that if Riaz Hussain, the owner, asserts that a violation of this

 

           

     clause has occurred I will abide by that assertion and will not be asking for

             

     a "proof" for such assertion.  In that case I will negotiate with Riaz Hussain

             

     to resolve the matter according to mutual satisfaction.  If this matter is not

             

     resolved to the mutual satisfaction of the renter and the owner then either

               

     party will have the right to terminate the lease with a 30 day notice and such

           

     notice will not be required to be from the 1st of the month to the end of the

             

     month.  In other words the notice referred to will be effective 30 calendar

               

     days from the date referred to in the notice as the "notice date" and not the

             

     actual date the notice is served. No oral modifications, or the like, will be entered

           

     Implied or read into this agreement.

                       
                             

     This clause will make an exception for occasional visitors and family

 

           

     visiting the rented residence of the renter.  I agree, however, that the

           

     determination as to who has been just a guest and who is permanently or

           

     semi-permanently staying at the rented residence under consideration, will

           

     be decided by the owner, Riaz Hussain.  I hereby agree that I will not

           

     question the judgment of the owner, Riaz Hussain in this matter.

               

     Renter is responsible for their guests and their actions.

 

Basically I understand that these are one bed room units and only one adult couple is allowed

We cannot have children since that will require a 2 bedroom unit by the St Paul code.

These are adults only buildings. You partner will cost you $175 per month in addition to the rent

for the unit. You, the renter will be responsible for the rent. Your partner is staying with

your permission and is not a signer of the lease and is not responsible for the rent. We do not have

any joint rental. In case of failure to pay we will hold you and only you, the signer responsible

3.)  I understand that all garbage must be bagged, tied, and put into the garbage

 

           

     containers provided, and that the garbage container covers will be closed

               

     after each usage. All garbage must fit the dumpster provided. If it doesn't,

             

     I understand that I am responsible for putting my trash in the trash container

           

     and not drop it all over the yard or stack it beside the trash container.  I am

             

     responsible for my cigarette butts (if I smoke) and my friends cigarette

               

     butts. I will dispose of them myself and not leave them all over the property.

             

     They will not be thrown into the trash container until they are completely

               

     cold so they don't cause a fire in the trash container.

                 

     I understand I will be charged for the large items.  I understand that before

             

     placing such large items by the dumpster for disposal I will inform the owner

             

     or building manager about this and make arrangements for payment for

               

     large item removal. I understand that failure to make arrangements or

               

     payments will be a breach of this addendum and hence of the lease agreement.                      -------------------------

           
                             
                             
                             

4.)  If Police are called out to my residence more than twice in one month, for

 

           

     any reason whatsoever, I will understand that, that will be cause for

               

     eviction with a 30 day notice.  If there are any police calls filed or incident

             

     reports made against myself or any other person at my rented residence

               

     my first offense will result in a notice to discontinue the actions that

               

     resulted in the police call. The second will result in immediate eviction,

               

     with a 30 day notice. Again, I will not be asking for a "proof" as to

               

     when the Police came or did not come to the rented residence.  Also, I agree

           

    to the determination of Riaz Hussain  in the matter.                                                                   --------------------------

                 
                             

5.)  I understand that if my sink, tub, or toilet plug up, due to circumstances

 

 

           

     caused by my actions or anyone in my apartment, it is my responsibility to

           

     to let the owner or Manager know immediately so that it can be fixed, and

           

     I will pay for getting it fixed.  No female products are to be flushed down

               

     the toilet EVER.                                                                                                                           -----------------------------

                         
                             

6.)  I understand that NO DRUGS OR CONTROLLED SUBSTANCES are to

 

           

     be used or abused in any manner whatsoever in the residence

               

     provided by Riaz Hussain!  I attest that I understand this thoroughly.

             

      I understand that I will not ask for "proof" for the use, sale or abuse

             

     of drugs or controlled substances in the residence provided by Riaz

             

     Hussain and that upon a simple written assertion that such use has

             

     occurred in the residence provided by Riaz Hussain, I will take a 15

             

     calendar day notice from Riaz Hussain and vacate the residence

               

     provided by Riaz Hussain.  I also understand that Riaz Hussain or his agent will

             

     have the right to unexpectedly visit, also patrol the property areas

               

     at his convenience.  Also, Riaz Hussain will have the  right to visit

               

     the property on short notice, such as a 1/2 hour, or in case of a 

               

    heating issue or immediate maintenance, he or his agents can gain

               

    immediate access.                                                                                                                    -----------------------------

                       
                             

7.)  I understand that there will be NO loud parties at the residence

 

 

           

      provided by Riaz Hussain.                                                                                                     -----------------------------

                     
                             

8.)  I understand that noise MUST be kept down after 10 P.M.  (This is a

 

 

           

     City Ordinance). THIS ALSO APPLIES TO ALL GUESTS.

                 

     If we receive any noise complaints regarding your apartment, upon the

               

     first request to comply, you will receive a notice to comply, upon the second

           

     offense you will receive a 30 days notice to vacate.                                                                  ----------------------------

                   
                             

9.)  I understand that NO pets are allowed in the property provided by Riaz

 

 

           

      Hussain, without written consent by owner with a pet deposit of $500 which will

           

      be required and is nonrefundable. Exceptions are for medical service animals

           

      that are validated by a medical service provider. For service animals ALL

             

     pet waste MUST be removed immediately. Failure to do so will result in termination

           

     of the lease agreement.                                                                                                          ------------------------------

                       

10.) I understand that if I damage any fixtures on or in the property or the

 

 

           

      property itself or the property grounds or any appurtenances of the

               

      property in any manner whatsoever I will have to pay to have it repaired or

             

      replaced. All maintenance will be handled by building manager and associate

           

      or property owner. I will not make any repairs/modifications/paintings

11.) I understand that I am responsible for my electric, gas and telephone and

 

           

      cable bills. Any new cable service MUST be approved by property owner,

               

      in writing. Failure to comply will mean the cable service will be removed

     without notice and destroyed. Please use the cable link in your unit provide for cable service.

    No new wiring is allowed. If your service provider cannot use the existing wire provided in the unit

    then you cannot have that service. In that case please do not rent the unit.                      --------------------------------

               
                             
                             

12.) I understand that in order to rent the apartment I need the rent for

 

           

       the first month,  and a damage and security  deposit

                 

       (equal to one month's  rent + $595) as spelled out, and

                 

      controlled by Clause (1) of the lease agreement. Also spelled out in clause 1 Above.                                                            -------------------------------

                 

      

                           
                             

13.) I understand NOT to contact the Landlord before 9:00 a.m. or after 10:00

 

 

           

      p.m., unless it is an emergency. In case of an emergency, call Owner/

14.) I understand that personal checks are not acceptable for rent, unless I

 

 

           

      have rented from Riaz for over a year and I have been approved for checks.

             

      I must pay my rent with a certified check, cashier's check, money

               

      order, or cash.                                                                                                                      ---------------------------------

                         
                             

15.) Only one (1) extension cord per room is allowed.  If more outlets are

 

 

           

       needed invest in a power strip.  (This is the Fire Marshall's Rule.)                                 ----------------------------------

               
                             

16.) Laundry facilities are provided.  DO NOT attempt to hook-up a washer and/

 

           

       or dryer in your unit.                                                                                                           ---------------------------------

                       
                             

17.) All appliances (stove, refrigerator, etc…) MUST NOT BE MOVED FROM

 

 

           

      THEIR ORIGINAL POSITIONS, except to periodically clean behind but  

             

      must be moved back to original position immediately. Failure to comply will

           

      be cause for an immediate eviction notice.                                                                        -----------------------------------

                   
                             

18.) Please do not communicate with the maintenance workers directly with

 

 

           

      any problems or concerns.  Contact the owner, Riaz Hussain, or the

               

      property manager, Desiree, with any questions or comments.  Please

               

      be advised that the maintenance people are under instructions to

               

      communicate with the owner or property manager only.                                                      -----------------------------

                 
                             

19.) All rent is due on or before the first of every month and is due in its

 

 

           

     entireity. No part payments will be accepted. If you are unable to pay the

           

     full rent then it will be understood that you do not have the rent and there-

               

     fore the legal process as stated in Item # 23 will be initiated.  It is your

               

     responsibility to get the rent into the property office. It is not the owner's

           

     or the managers' responsibility to collect the rent from you.

               

 '    If you know your pay schedule is different than the first of the month, please

           

     request a different pay schedule (up to the 5th of a month and no later)

               

     with the landlord or manager prior to signing the lease. This will be at

               

     the owners discretion and it will be up to the landlord whether a late fee will apply.

           

     This may vary on a case by case basis. The rent is due at the

               

     rental office at 25607 N 153rd Ave Surprise AZ 85387, Monday-Saturday Via Zelle or   

     other method. For Zelle use the phone number (651)442-9044. Or it will be collected by

     the property Manager on or before the 1st of the month or your agreed upon payment

     date.

20.) If the rent is not in on or before the first of the month, and you do not

 

 

           

      have a prior written agreement to pay on another date, each month, you

               

      will be charged a $95.00 late fee. A failure to pay the $95.00 late fee will

               

      result in an immediate filing of an Eviction. Please have a clear

               

      understanding of this.

                       

      There is a $75.00 charge to come out and unlock a tenant door, due to a

             

      lockout, before 9 p.m. After 9 p.m. to 12 a.m. the fee is $150.00 and after

               

     12 a.m. to 9 a.m. the fee is $195.00 due at time for service. Any damage

             

     caused to the door by trying to pry open the door due to being locked out

               

     will result in your being charged for any repairs or replacement and

               

     may result in an eviction letter.                                                                                                   -------------------------

                     
                             
                             

21.) Failure to pay the rent or to communicate with the owner or property

 

 

           

      manager by the 1st of the month, will result in the filing of an Eviction

               

      action with the Ramsey or Hennepin County district court on

               

      the 3rd of the month or the next working day. I understand that no

               

      one will call or come to collect the rent.                                                                                     -------------------------

                     
                             
                             

22.) All legal expenses incurred by the owner, Riaz Hussain, for enforcing the

 

           

      rules and agreements of this lease, for any Eviction and Sheriff fees, for

               

      serving the Eviction, will be payable by the renter. I will be responsible for

             

      any remaining unpaid balances, repair charges, cleaning charges and all

               

      fees incurred during my tenancy and any charges for damages or cleaning

             

      of the unit. This includes all of the attorney's fees, legal expenses, filing

               

      fees and parking fees incurred in connection with my eviction or .

               

      occupation of the unit. This also includes judgments executed against

               

      me and penalties and interest associated with amounts outstanding

               

      against me. I understand any remaining balances due upon my departure

             

      will immediately result in collection action for the amounts outstanding

               

      against me and that after the collection action, legal means will be used

               

      culminating in the attachment of my assets and garnishment of any wages.                                  -------------------

             
                             
                             

23.) I understand that a breach of any of the rules will be a cause for

 

 

           

     immediate cancellation of the lease and be cause for eviction,

               

     that the determination as to the occurrences of such a breech

               

      or breeches will be a matter of determination for Riaz Hussain and

             

      I will not contest or require "proof" of any such breech or breeches

             

      and that I will accept the decision of Riaz Hussain in this matter.  In

             

      such a case I will take a 15-day notice and vacate the property in

               

      question for Riaz Hussain.                                                                                                   --------------------

                     

 

 

                                                                Warning:

 

Any breach of the lease or the addendum or any clauses herein will lead to an immediate eviction

Action without warning under clause 27 below. We are not going to produce a proof of the violation and the argument

and counterarguments about this. You will simply receive a letter asking you to cease the said activity in violation of the

lease or the addendum to the lease or both.

 

Then if the activity ceases you have nothing to worry about. If it does not you will a 30 day notice to leave the unit under

Clause 27, below.

 

Remember we are not in the business of losing or harassing our rents. We are in the business of renting and getting

Rent! We need our renters more than they need us. But we still have to enforce the lease to protect the property from

Damages and any fanatical losses or any code violation of the city and State of Minnesota. Please understand that this

Very crucial clause of the lease and the addendum. This is designed to protect the building and to follow the state laws

and not to inconvenience the renters. So if you have  pets or children or a business or intend to use or sell contraband

from this unit or intend to allow other unauthorized persons live there, please do not rent this unit. There are other places where you can do this. If you where you can do this. Do not rent this unit.

24.) I fully understand these simple rules and I guarantee that I will not

 

           

      risk a breach of any of these rules in the expectation or hope that

               

      Riaz Hussain will not find out about such a breech and I understand

             

      that a "NO" means "NO" and I will try not to redefine the meaning of

             

      "NO" by relating my "NO" to such things as circumstances or "my"

             

      understanding.  I understand that it is not my understanding of any of

           

      these rules that is paramount but the understanding of Riaz Hussain

             

      that is paramount and that he has fully explained such understanding,

           

      that I have grasped it and that Riaz Hussain has amply explained this

           

      understanding and interpretation of these rules governing the rental

           

      of this property over and over again.  I fully understand that I have

             

      been properly warned about the consequences of any breeches of

             

      this lease agreement and this addendum.                                                                           -------------------------

                   
                             

25.) When moving out the schedule of charges attached will apply.  These will

 

           

      be used to determine my liability when you move out without returning the

             

      unit to the condition it was in when I rented it.  Recall that you were

               

      shown this condition and you signed the unit pre-rental checklist at the

               

      time of rental.  This checklist is on file for every renter. Pictures will be taken

           

      upon your move-in and departure.                                                                                           -------------------------

                     
                             

26.) I hereby affirm that Riaz Hussain or the property manager has shown

me the

 

           

      entire property and all of the appliances and fixtures and that they

             

      have been shown to me to work in satisfactory order, that Riaz

               

      Hussain at this time, has no plans to change any of the fixtures or

               

      appliances but that if and when there is a failure of any appliances

             

      from its current state of operation, it will be fixed back to its current

             

      position or better by Riaz Hussain.  I also affirm that the rental

               

      unit shown to me with its current state of operation is acceptable

               

      to me for renting.  I understand also that Riaz Hussain may from time

           

      to time replace or repair any or all of the fixtures or other appurt-

               

      enances as and when practical for him to do so.  I also understand

             

      that Riaz Hussain will keep the property in a state of operation which

           

      will minimally meet the requirements of the relevant Local County

             

      Housing Authority and that Riaz Hussain is not obliged to meet any

             

      other requirements such as those of the renter (whether imagined

               

      or real) or those of any other institutions or local bodies having no

               

      jurisdiction in the matter.                                                                                                        ---------------------------

                       
                             

27.) Although this lease is for a one-year period, either side

 

 

           

       can terminate it with a one calendar month (or any 30 days)

           

      notice in writing, without assigning any reason.

                 

      In case there is no such notice from either side

                 

      the lease will continue indefinitely.  I attest that I have

               

     understood this clause thoroughly.                                                                        -----------------------

                   

    

                           

28.) BREAKING OF ANY OF THESE RULES WILL BE CAUSE  FOR

29.)  It is recommended that all tenants carry rental insurance pursuant 

 

           

        toClause 8 of the Lease Agreement.                                                                     -----------------------

                   
                             

30.) Every written lease written for any property owned by Riaz Hussain

 

           

       includes a requirement that the following activities will not be allowed

           

      on the premises:

                       

         A. The making, selling, possessing, purchasing or allowing

               

             any illegal drugs.

                       

         B. Buying, selling, using or possessing any firearms

                 

         C. Buying or selling any stolen goods

                   

         D. Buying, selling or using prostitution or related activities

          E. No business of any kind whatsoever can be carried from the rental unit.

               

              Non-compliance will result in immediate termination of lease and eviction.                    

          F. UPS and Amazon or other delivery packages cannot be delivered to your unit.

               Please make other arrangements. No deliveries to the unit address. No signs in the windows

              About “deliveries in the back or something”. There is no rental office in the building and

              Packages cannot be received for you. We are sorry for this inconvenience. You can have them

               delivered outside the building but at your own risk.                                            ----------------------------

           
                             

31.) If there is a garage at the residence you are renting, there is no parking

               

      in the back and this includes the side of the garage for you or any visitors,

             

      at any time. Violators will be towed at your expense.                                                      ---------------------

                 
                             

32.) I understand this apartment is for the person(s) on the lease, any

               

      other person will need to be added to the addendum to the lease and

           

      the rent will increase by $175.00. If we find any person staying in the unit,

           

      not on the lease or the addendum, then that will be cause for IMMEDIATE eviction. ---------------------------

       
                             

33.) I understand that no changes or modifications are allowed to any

           

      of the appurtenances of my unit. This includes moving the fridge, stove or any

           

      repair/change work in the unit. In particular, any changes/replacements of the unit door locks and any and all

      work is strictly prohibited.

      I understand that if I change my lock or locks, the owner will immediately drill out

       

      the lock or locks and replace it (them) with new lock or locks and I understand that I will not get a key for the

 

      until I pay in cash for the drilling/replacement of the lock or locks  and I understand that if I try to enter the

   

     unit with the new lock or locks without a key, a breaking and entering complaint will be filed with the police

   

     immediately and that I will not be able to enter my unit until I pay for the drilling/replacement of the lock or

locks.

 

     I also understand that after I have paid for the lock drilling/replacement and given access to my unit with

   

     the new lock or locks , I will be served a 30 day notice (not a calendar month!) on the spot to vacate the unit

and

 

     that this eviction action will be recorded in my rental record at the property and will be reported in all

     

     future rental references on my behalf. I attest that I  have understood this clause most thoroughly and

     

     will not risk tampering with the unit appurtenances and in particular the locks in the unit as that

     

     will terminate my tenancy immediately with a negative record entered in my rental history. DO NOT TAMPER

WITH THE

 

     LOCKS. YOU HAVE NO RIGHT TO DO SO UNDER THIS CLAUSE. YOU DO NOT OWN THE UNIT. YOU ARE

RENTING IT UNDER A

     LEASE AGREEMENT AND THE ADDENDUMS TO The LEASE.

               
                             
                             

      We hereby attest that we have read the above addendum to the Lease

           

      Agreement and have understood all the clauses  and hereby agree to abide by

34. I understand that Riaz Hussain, the owner does not provide any off-street parking for renting a unit at this building.

 Parking is on street only and is not the responsibility of the owner. But that I can rent ONE and only ONE spot for an

extra payment of $30 per month. See the Parking Addendum to this lease if you want to rent one.

I understand if I have not entered into this additional parking contract with the owner Riaz Hussain, my car will be towed

Without warning, that this is my warning about towing and will not be repeated and that I understand it. I understand

that I will not and cannot bring any actions against the property owner about the towing of my car or any expenses

 therefrom..I understand that the towing rules apply to all my visitors that park in the parking lot since they will be

 parking there without authorization. Illegal parking will not be tolerated for even ONE minute. If an illegal car is spotted

by the towing company, it will be removed immediately. The towing company information is posted on the back wall of the

building. Please: DONOT GET YOURSELF INTO TROUBLE. I CANOT HELP YOU. THIS IS YOUR FIRST AND

ONLY AND THE LAST WARNING!! Please do not rent form us if you are planning to violate this rule or do not accept it.

NO Parking REASON: The parking lot is on a slant into the alley. It cannot stand excessive parking and is designed

only for small cars and for infrequent use. Excessive use and heavy vehicles cause serious damage to the lot

 as they go up and down.

 

Recommendation: Do not rent a parking spot. The lot cannot stand it. Our intent is to discourage the use

 of the parking lot. There is plenty of on street parking available in the neighborhood. If this not acceptable,

 35. I hereby agree that I will sign for all notices as and when they are given to me by the property manager or

Riaz Hussain. That, if I refuse to sign for a notice received by me or given to me by the property manager

Or Riaz Hussain, that will be a breach of this addendum and the lease agreement and hence will lead

36. The lease agreement spells out that you need to carry your own

Renter’s insurance. We do not provide that.

I hereby understand that in case of any and all damage to my property or any and all or or injuries to person or persons living under this lease

or other harm  sustained  in the building or while living

or moving or staying there and any other injuries whatsoever, I will

hold Riaz Hussain, The property owner, harmless from any claims

whatsoever in a court of law or anywhere else whatsoever. I certify

that Riaz Hussain will not be the subject of any lawsuits or any

 liabilities arising from my renting or using or living in his rental

 units. I hereby relinquish any and all claims against him for anything

or any item whatsoever.
